Summary of Terms of Use for JamiGold.com

Don’t violate our copyright, don’t be a jerk, and don’t expect our content to result in a specific outcome (we provide knowledge and insights, not a map to guaranteed success). We’re not responsible or liable for how you choose to use or apply our advice or other content (we’re helpful, not perfect at knowing what would be best for your situation).

Full Privacy Policy and Terms of Use for JamiGold.com

This Privacy Policy is meant to inform those who are concerned with how their Personally Identifiable Information (PII) is being used online. 2: How do we collect information from you?

Most of our site's features don't require you to share Personally Identifiable Information (PII), allowing you to visit our site without telling us who you are. However, some features won't work properly if you choose to withhold your PII.

The features that require you to share PII include (but aren't limited to):

  • leaving a comment or filling out a form
  • becoming a site member
  • enrolling in a course or product
  • subscribing to a newsletter (including when signing up to receive a free guide or other tool)
  • ordering a product or service
  • registering for our ARC (Advanced Reader Copy) Team or Backstage Pass program
  • requesting a review copy of a book
  • submitting a testimonial

3: What type of information is collected from you?

The personal information we collect might include your name, address, email address, IP address, and information regarding your submission or request (such as your account sign up, testimonial, newsletter subscription, or product purchased).

Like other websites, we use Google Analytics, which attempts to collect information that is less personal, such as browser type (Firefox, Chrome, etc.), browser version, and pages viewed. We also use affiliate links for Amazon, so if you click on Amazon links from our site, some non-personal information about your purchases is collected by our Amazon affiliate account.

For our comment system, we collect information about those visitors who comment for our Akismet anti-spam service. The information we collect includes the commenter's IP address, user agent, referrer, and Site URL (along with other information directly provided by the commenter, such as their name, username, email address, and the comment itself).

If you purchase a product from us, your card information is not accessed or held by us, as it is collected by our third party payment processors (i.e., PayPal/Stripe), who specialize in the secure online capture and processing of credit/debit card transactions. The information we collect during the checkout process on our store may include, but is not limited to, your name, billing address, shipping address, email address, phone number, payment details, and any other details that might be requested from you for the purpose of processing your orders.

Additionally, we may also collect the following information during a purchase, email signup (such as when requesting a free guide or completing a quiz), comment or testimonial submission, or membership signup:

  • Location and traffic data (including IP address and browser type) if you place an order, or if we need to estimate taxes and shipping costs based on your location.
  • Product pages visited and content viewed while your session is active.
  • Your comments, which may also connect to an avatar image, if you choose to leave them on our website.
  • Account email/password to allow you to access your account, if you have one.
  • If you choose to create an account with us, your name, address, and email address, which may be used to populate the checkout for future orders.
  • If you choose to become a site member, your name, email address, and other optional information (such as a profile image, website, and/or bio), which will be used to populate your membership profile and account.
  • If you choose to sign up for email (through blog posts, free books/guides, quiz signup, membership registration, or direct interest signup forms, etc.), your name, email address, and interests in our products and information, which will be used to provide emails tailored to your requests and interests.
  • If you submit a testimonial, you may also choose to connect to an avatar image.

4: How is your information used?

We may use your information to:

  • check comments for spam or moderation status
  • display your comments on a site page or post
  • send you communications you've requested or expressed an interest in
  • process orders you've submitted
  • log you into the site to allow access to purchases and member benefits
  • create a Certificate of Completion for students of some courses
  • deal with requests for special consideration (contest giveaways, ARC fulfillment, review copies, editing feedback, etc.)
  • personalize your experience and deliver the information in which you've expressed an interest
  • follow up after requested communications to provide extra information or to ask for assistance
  • improve the functionality and/or engagement of the site (track shares on posts, open rates of newsletters, etc.)
  • display your testimonial on this site or on other media sites/accounts controlled by us
  • maintain internal records

For example, when visitors leave comments on the site, we use their IP address and browser information to help detect spam, or we use their email address and other information to determine if their comments should be moderated before display. Also an anonymized string created from your email address (also called a hash) may be provided to the Gravatar service so that after approval of your comment, an avatar profile picture of WordPress/Gravatar account holders is visible with your comment. However, other than the Akismet anti-spam service and the connection to Gravatar, our comment system is local, so your information is not sent to third parties for comment processing or display.

If you purchase something from this site, handling the store-related data allows us to:

  • Send you important account/order/service information.
  • Respond to your queries, refund requests, or complaints.
  • Process payments and to prevent fraudulent transactions.
  • Set up and administer your account, provide technical and/or customer support, and to verify your identity.

We don't use your information for purposes other than what you intend. For example, leaving a comment will not automatically subscribe you to our newsletters or marketing information, etc.

For the best experience of our visitors, we generally don't delete information unless requested (see sections #6 and 7 below). For example, many of our products come with a lifetime-access guarantee that requires us to keep purchasers on record, information included with comments remains unless the comment itself is deleted, etc.

For users that register on our website as a member, we also store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.

We don't currently track our visitors across other websites, use Google AdSense/AdWords, or allow advertising on our site, so your information is not currently used by us for targeted ads. However, we do use Google Analytics, which might collect information used by Google.

Other third parties beyond our control might collect information through tracking and cookies as well. It's possible to discourage tracking and/or disallow use of cookies through your browser (see section #9 below).

5: Who has access to your information?

Only Jami Gold and her administrator-level associates of this website have access to your information on our server. We will not sell, trade, or rent your information to third parties, and we will not share your information with third parties for other marketing purposes.

(Notice for CCPA: Although we won't sell your personal information, this site includes cookies and links to third-party sites, and those sites may track and/or have other personal information policies. If you're concerned, we recommend using the "Cookie Settings" link in the footer to ensure you've disabled cookies in the categories that may include third-party tracking, such as Marketing. As a backup, you may also opt out here: Do not sell my personal information.)

We may pass your information to our third party service providers for the purposes of completing tasks and providing requested services to you on our behalf (for example, to process orders or send ARC invitations, to create Certificate of Completions for students of some courses, to follow a visitor's journey through our site to provide more relevant information online and in emails, to provide easy social sharing methods to visitors, or visitor comments may be checked through an automated spam detection service). However, when we use third party service providers, we disclose only the personal information that is necessary to deliver the service. We won't release your information to any other third parties unless we are required to do so by law.

When you use our secure online store, your payment is processed by a third party payment processor (i.e., PayPal). If you have any questions regarding those secure transactions, please refer to their policies.

6: What are your choices?

You have a choice about whether you wish to share information with us or to receive information from us. If you decide not to share some PII with us, we may not be able to provide you some of the features and functionality of the site.

However, we will not contact you for marketing purposes unless you've given your prior consent. We require explicit confirmation for our newsletter subscribers, and we encourage those who change their mind about their interest in our messages to unsubscribe by offering explicit invitations/reminders and instructions.

You can change your subscription preferences for either informative and/or marketing purposes at any time by clicking the links at the bottom of every message to subscribers or by requesting through this form to have your information removed from our records. If you have an account on this site, or have left comments, you can request to receive an exported file of the personal data we hold about you, including any data you have provided to us. (Note that an administrative fee may be charged for gathering the data for an export request, depending on the complexity and extent of your points of contact with this site.)

However, the "right to be erased" does not include any data we are obligated to keep for administrative, legal, or security purposes.

7: How can you access, update, or delete your information?

You can update your preferences for newsletter subscriptions or our ARC Team at any time by clicking the links at the bottom of every message to subscribers.

To access, change, or delete your information gathered from other processes (such as a product order or the Backstage Pass program), please contact us at our Contact Form.

For some requests—such as changing data on your comments across our site—a fee may be charged, as we'd need to contract with our hosting company to complete your request. At the time of your request, we can investigate and respond with fee information.

8: What security precautions are in place?

We contract with a server hosting company with an aggressive policy toward computer hackers and other server/networking risks. They take security just as seriously as we do, but no online data can be guaranteed 100% secure.

Our entire site uses SSL/https encryption. While we can't control how your computer transmits information to us, once we receive your information, we make our best effort to ensure its security on our systems.

9: What about the use of “cookies"?

Like many other websites, we use cookies—tiny text files that are used to store small pieces of information on your computer to allow our website to recognize you when you visit. They are stored on your device when the website is loaded on your browser. They do not identify you as an individual, but help us improve our website and deliver a more personalized and relevant experience. Most cookies automatically expire, after a year, a month, a day, or sooner.

Our website uses first-party and third-party cookies for several purposes. First-party cookies are mostly necessary for the website to function the right way. The third-party cookies used on our website are mainly for understanding how the website performs, how you interact with our website, keeping our services secure, and overall providing you with a better and improved user experience, which may also help speed up your future interactions with our website.

For more about our use of cookies, a report of your current consent settings, and a listing of the specific cookies used on this site, please refer to our Cookie Policy & List.

For a few examples, while on our site, cookies may be used to:

  • identify any new comments on a post since the last time you visited that page
  • add your avatar to your comments (by matching your email address to your WordPress/Gravatar account)
  • pre-fill in your information in a comment form if you've left a comment before
  • pre-fill in your account information if you visit a page with a login function
  • keep products in your cart while you continue browsing our site
  • determine your interests to share more relevant information to you

If you leave a comment on our site you may opt-in to saving your name, email address and website in cookies. These are for your convenience so that you do not have to fill in your details again when you leave another comment. These cookies will last for one year.

If you visit our login page, we will set a temporary cookie to determine if your browser accepts cookies. This cookie contains no personal data and is discarded when you close your browser.

When you log in, we will also set up several cookies to save your login information. Login cookies last for two days, and if you select "Remember Me", your login will persist for two weeks. If you log out of your account, the login cookies will be removed.

Use of this site without blocking settings means you agree to allow cookies to be placed on your computer. We don't have access to your computer through our use of cookies, and we don't have access to cookie data stored on your computer beyond what you choose to share with third-party sites (like Google Analytics) on our behalf.

Should you decide to change your preferences later through your browsing session, you can click the "Cookie Settings" link in the footer shown on every page. This will display the consent popup, enabling you to change your preferences or withdraw your consent from all but the "Necessary" category of cookies.

For more about our use of cookies, as well as a listing of the specific cookies used on this site, please refer to our Cookie Policy & List.

10: What about links to other websites?

Our website contains thousands of links to sites run by other organizations. Also, articles on this site may include embedded content (e.g. videos, tweets, etc.). Embedded content from other websites behaves is if the visitor has visited the other website. These websites may collect data about you, use cookies, embed additional third-party tracking, and monitor your interaction with that embedded content, including tracing your interaction with the embedded content if you have an account and are logged in to that website.

This Policy applies only to our website, so we encourage you to read the privacy statements on the other websites you visit. We cannot be responsible for the privacy policies and practices of other sites even if you access them using links from our website. Nonetheless, we want to protect the integrity of our site and the safety of our visitors, so we welcome any feedback about links to questionable sites.

In addition, if you visited our website through a link from a third party site, we cannot be responsible for the privacy policies and practices of the owners and operators of that third party site and recommend that you check the policy of that third party site.

We provide these affiliate links on the website for your convenience, we have no control over these external websites, and they are solely responsible for their own content and information presented.

In accordance with the FTC guidelines concerning use of Endorsements and Testimonials in advertising, please be aware of the the following:

Testimonials appearing on this site are the result of text, audio, or video declarations made directly to this site, in this site's comments, on retailer sites, or on social media. They are individual experiences, reflecting real life experiences of those who have used our products and/or services. However, individual experiences and results vary, and we do not claim that the posted testimonials reflect typical results that others can achieve, as they may not necessarily be representative of all those who use our products and/or services.

The testimonials are displayed verbatim, except for correction of grammatical or typing errors, and may have been shortened to highlight relevant portions while maintaining the overall message and perspective of the user's declaration. We are not responsible for our users' opinions, and we may not share the opinions, views, or commentary of user declarations, as they are strictly the opinion of the user. We provide testimonials simply as a means for customers to share their experiences with one another. To prevent abuse, all testimonials are reviewed by administrators before being displayed, and we never pay for testimonials, as we want all information to be honest and true.

These terms shall be governed by the laws of the State of Arizona without regard to the conflict of laws or rules of any jurisdiction. Every dispute concerning the interpretation or effect of these Terms of Use and/or your use of the site must be resolved in the state or federal courts situated in the State of Arizona. You agree to the personal jurisdiction, subject matter jurisdiction, and venue of these courts.

3: Editing Services

(All editing services are contracted with Jami Gold specifically. Use of "we" or "our" in this section refers only to Jami Gold and not to any others assisting with this site.)

Our editing clients are granted full rights to incorporate editing suggestions as they see fit, including word-for-word inclusion. We release all claims and rights to the text in our text-change suggestions of an edit.

Editing services are offered "as available" and as we determine a good fit between our editing skills and your story. We may request the first few chapters to review before contracting to ensure we're the right editor for the story.

Projected timeframes and deadlines are not always precisely accurate, as writing and editing are both artistic activities, where durations are hard to estimate. We'll work with clients to accommodate to the best of our ability any timing adjustments needed by either party.

If accepted as a client, you'll need a deposit of 50% (based on estimated word count) to hold an available calendar slot. Once editing is completed, a final amount will be calculated based on actual word count and any changes in editing level agreed upon by the parties. Invoices are due upon receipt, and we may withhold delivery of the editing feedback until paid in full.

After return of editing feedback, we will answer client questions about the feedback and suggestions. If the client has questions beyond the feedback itself—such as asking for a reread of a section—additional fees may be charged.

We will analyze and edit the material(s) according to the specifications listed on the site for the service purchased. Feedback requested beyond those specifications may incur additional fees.

We make no representations or guarantees our edit will find every possible issue or potential improvement in a story. Just as every reader can interpret a story differently, every editor will find different issues, but we spend considerable time on every editing project to find as many problems and offer as many suggestions as possible.

During the course of a Summarized or Full Developmental Edit, we may suggest a switch to the Book Doctor level if we discover serious issues with the story and feel a deeper analysis and discussion of the issues is necessary. The client has final say over this choice, but we reserve the right to stop the edit at that point and provide all analysis and notes compiled so far in exchange for any remaining payment of the word count completed.

A story analysis can identify and suggest fixes for many issues, but it's not a replacement for a developmental edit. Similarly, developmental edits are an important step in the editing process, but they are not intended to point out grammatical, sentence structure, or wording problems. Line and/or copy edits are still recommended.

Although we hope you'll be happy with our services, we make no guarantees of satisfaction due to the subjective nature of the industry. We also make no guarantees of results, saleability, or marketability from implementing our advice or suggestions.

4: Refunds and Indemnification

If you have any concern or dispute about the site or its contents, services, or products, you agree to first try to resolve the dispute informally by contacting us directly.

Regardless of satisfaction or results, services and online products can't be "returned," so all sales of products and/or services on this website are final. No refunds will be issued, except in cases where the service or product was never delivered. A user's subsequent inability to access the service or product after initial delivery is not cause for a refund.

As evident by the fact that over 99% of the information on this website is available for free, we truly believe in giving more than receiving and each of our products and services is designed by keeping this core principle in mind. The prices are intentionally kept reasonably low in price as compared to market value to give you the tools and information you need at an affordable price.

If you make a purchase through our store, you authorize our payment processor to immediately collect the amount due. If you contact your credit card or financial services provider to request a chargeback despite successful delivery of our service or product, we reserve the right to terminate your account (including access to any and all products purchased).

Use of this site means you agree to indemnify and hold us—and Jami Gold specifically—harmless from and against any and all claims, damages, costs, and expenses arising from or related to use of our site, content, tools, services, courses, or products. You expressly waive your right to bring any legal claims, now or in the future arising out of or related to the website and our products/services.

In the event of any dispute, claim or controversy arising out of or relating to your use of this website, the terms and conditions shall be construed in accordance with the rules and regulations of the state of Arizona and the United States. You agree to consent and submit to the jurisdiction of the state and federal courts located in Arizona without regard to the principles of conflict of law or where the parties are located at the time a dispute arises.

You agree to resolve any disputes or claims first through mandatory arbitration in the state of Arizona and shall bear the full cost of arbitration as permitted by law. Your good faith participation in arbitration is a condition precedent to pursuing any other legal or equitable remedies available such as litigation or any other legal procedure. You also agree that in the event a legal claim is initiated after the required arbitration, the prevailing party shall be entitled to recover reasonable attorney’s fees and other costs associated with the legal action.

In addition, use of this site means you understand and agree that we are not responsible for content from others, including but not limited to: guest posts, comments, embedded content, third-party services and links, etc. You agree to indemnify and hold us harmless from and against any and all claims, damages, costs, and expenses arising from or related to exposure to, or reliance on, content from others.

These Terms and Conditions along with our Privacy Policy and Cookie Policy constitute the entire agreement between you and us with respect to this website. It supersedes all prior or contemporaneous communications, discussions, negotiations or proposals we may have had with you whether electronic, oral or written.

A printed version of this entire agreement including the Privacy Policy and Cookie Policy and of any notice given in electronic form shall be admissible in judicial or administrative proceedings with respect to this website to the same extent and given the same effect as other business contracts and documents kept and maintained in printed form.

If any provision in these Terms and Conditions or other policies is deemed by a court, regulatory authority or other public or private tribunal of competent jurisdiction to be invalid or unenforceable, such provision is deemed to have been omitted from this Agreement. The remainder of this Agreement remains in full force and effect, and is modified to any extent necessary to give such force and effect to the remaining provisions, but only to such extent.

Claims of Copyright Infringement and Related Issues
As creatives ourselves, we strongly support and respect the intellectual property rights of others.

If you are aware of others infringing upon Jami Gold's intellectual property, we greatly appreciate you letting us know through the Contact form or through the agent information listed below. Please try to include all relevant information in your notice so we can decide how to proceed.

Similarly, anyone who believes their work has been reproduced on this site or in Jami Gold's other content, tools, services, or products in a way that constitutes copyright infringement may notify our agent by providing the following information:

  1. Identification of the copyrighted work that you claim has been infringed, or, if multiple copyrighted works of a single online site are covered by a single notification, a representative list of such works of the site;
  2. Identification of the material that you claim is infringing and needs to be removed, including a description (such as the URL or name of the tool or product) of where it is located so that the copyright agent can locate it;
  3. Your address, telephone number, and e-mail address, so that the copyright agent may contact you about your complaint;
  4. A signed statement that the above information is accurate; that you have a good faith belief that the identified use of the material is not authorized by the copyright owner, its agents, or the law; and, under penalty of perjury, that you are the copyright owner or are authorized to act on the copyright owner’s behalf in this situation.

Upon receipt of a notification, we will take whatever action, in our sole discretion, we deem appropriate. If a valid claim is found, we will act expeditiously to remove, or disable access to, the material on our site. Please be aware that there are substantial penalties for false claims.

If a notice of copyright infringement has been wrongly filed against you, you may submit a counter notification to our agent. A valid counter notification is written communication that incorporates the following elements:

  1. A physical or electronic signature of the poster;
  2. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled;
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification;
  4. Your name, address, and telephone number; a statement that you consent to the jurisdiction of federal district court for the judicial district in which your address is located, or if your address is located outside of the U.S., for any judicial district in which the service provider may be found; and that you will accept service of process from the complainant.
